Terms of Service (Uniqueer)

These Terms govern your use of Uniqueer. By using Uniqueer you agree to these Terms.

1. Eligibility

Uniqueer is for adults (18+) only. By using Uniqueer you confirm you are at least 18.

2. Accounts and access

• Register via email+password or OAuth (Apple/Google/Instagram/Facebook/X).
• Keep credentials secure; you are responsible for activity on your account.
• Public by default: your profile and posts are publicly visible. No private-account mode.

3. Content on Uniqueer

3.1 Your content

You own your content. To operate the Service, you grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reproduce, modify (e.g., transcoding, resizing, formatting), publish, display, distribute and make derivative technical copies of your content for operating, improving, and promoting the Service, while it remains on Uniqueer (and for a reasonable period in backups per the Privacy Policy).

3.2 Publicity & NSFW

Content is public by default. NSFW/18+ content must be properly labeled; it is hidden/blurred by default and shown only after an 18+ acknowledgment.

3.3 Prohibited content & conduct

• Hate speech, discrimination, harassment, threats, doxxing.
• CSAM, terrorist/extremist content, explicit illegal content.
• Revenge porn, forged consent, intimate imagery without documented consent.
• Inciting violence, coordinating harm, facilitating illegal activity.
• Spam, ranking manipulation, unauthorized scraping/automated collection.
• Impersonation, misrepresentation, unlawful disclosure of private info.
• Bypassing security or disrupting the Service.

4. Intellectual Property

We and our licensors own the Service, software, and brand. You may not copy, modify, distribute, reverse engineer, or create derivative works except as allowed by law.

5. Third-party services & platforms

OAuth providers (Apple/Google/Instagram/Facebook/X) have their own terms and privacy notices; we are not responsible for them. Our website is hosted by third-party infrastructure (e.g., hosting/CDN providers) solely to deliver the site; they are not parties to these Terms. If you access Uniqueer via app stores or their services, you acknowledge that the store operators are not responsible for the Service and have no warranty or support obligations for it.

6. Safety

We use measures to keep Uniqueer safe but cannot guarantee it. Exercise caution with public posting. Avoid sharing information that could put you or others at risk.

7. Service changes & availability

We may change, suspend, or discontinue features at any time. The Service may be unavailable during maintenance, incidents, or for security reasons. We do not guarantee uninterrupted availability or retention of content, backups, or data, except as required by law or our policies.

8. Termination

You may stop using Uniqueer or delete your account at any time (with a 30-day grace before final deletion). We may suspend/terminate access if you breach these Terms, if required by law, or to protect users or the Service.

9. Disclaimers

UNIQUEER IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages; or any loss of profits, data, goodwill, or other intangible losses. Our aggregate liability is capped at the greater of €50 or the amount you paid us (if any) in the prior 12 months.

11. Indemnity

You will indemnify and hold us harmless from claims arising out of your content or your breach of these Terms or applicable law.

12. Governing law & disputes

These Terms are governed by the laws of Ukraine. Disputes are resolved in Ukrainian courts, unless mandatory consumer law provides otherwise.

13. Changes to Terms

We may update these Terms; new versions will carry a new “Last updated” date.

15. Feedback

If you send ideas or suggestions, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use them without obligation to you.

16. General

• No waiver: failure to enforce a provision is not a waiver.
• Severability: if a provision is unenforceable, the rest remain in effect.
• Assignment: you may not assign these Terms; we may assign as part of a merger, acquisition, or sale.
• Entire agreement: these Terms are the entire agreement regarding the Service and supersede prior terms.
• Headings: for convenience only and do not affect interpretation.
